Terms of Service

These Terms of Service ("Terms") govern your use of the ESAexpert website at www.esaexpert.co.uk ("the Service") operated by ESAexpert ("we", "us", "our"). By using the Service or purchasing any of our products, you agree to these Terms.

ESAexpert provides personalised guidance to help you describe your health conditions on ESA50 and UC50 forms for the Work Capability Assessment (WCA). Our products include:

ESAexpert provides guidance only and does not constitute legal, medical, or benefits advice. We are not a law firm, not a registered charity, and not affiliated with the Department for Work and Pensions (DWP).

Our guidance is based on the Employment and Support Allowance Regulations 2008/2013 (Schedule 2) and publicly available DWP assessment criteria. However, we cannot guarantee any particular outcome for your WCA claim. The decision on your entitlement rests solely with the DWP.

If you need formal legal advice about your claim, we recommend contacting Citizens Advice, a welfare rights adviser, or a solicitor specialising in benefits law.

3. How Our Service Works

You provide information about your health conditions and how they affect your ability to work. This information is processed using AI technology (provided by Anthropic) to generate personalised guidance matched to the official WCA descriptor framework.

Your report is generated instantly after payment and can be downloaded as a PDF. The guidance is unique to the information you provide.

Payments are processed securely by Stripe. We never see or store your card details. Upon successful payment, your report is generated and made available for download immediately.

6. Refund Policy

Because our reports are personalised digital products generated instantly upon purchase, we are unable to offer refunds once a report has been generated and made available to you. This is in accordance with the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, which allow an exception to the 14-day cooling-off period for digital content that has been accessed.

However, if you experience a technical issue that prevents you from accessing your report (e.g. payment taken but report not generated), please contact us at support@esaexpert.co.uk and we will resolve the issue or provide a full refund.

We take your privacy seriously. Information you provide to generate your report is processed in real time and is not stored on our servers after your session ends. For full details, please read our Privacy Policy on the main site.

8. Intellectual Property

The ESAexpert website, branding, and underlying technology are our intellectual property. Your generated report is for your personal use in connection with your WCA claim. You may share it with advisers, support workers, or family members helping you with your claim.

9. Limitation of Liability

To the maximum extent permitted by law:

We may update these Terms from time to time. The "Last updated" date at the top of this page will be revised accordingly. Continued use of the Service after changes constitutes acceptance of the new Terms.

These Terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
